NOTICE OF TRUSTEE'S SALE OF CERTAIN PROPERTY LOCATED IN HENRY COUNTY, VA, AND DESIGNATED AS 24 HILL AND DALE ROAD, MARTINSVILLE, VIRGINIA PARCEL ID: 069970001 In execution of a Deed of Trust from Linda C. Frazier, dated September 29, 2000, recorded October 4, 2000, as Instrument No. 005387, in Deed Book 892, at page 381, in the Clerk's Office of the Circuit Court of Henry County, Virginia (the "Deed of Trust"), the Substitute Trustee, Clement & Wheatley, a Professional Corporation, having been substituted as Trustee pursuant to a Deed of Appointment of Substitute Trustee recorded among the aforesaid land records, and having been requested to do so, will offer for sale at public auction, at the main entrance to the Henry County Circuit Court located at 3160 Kings Mountain Road, Martinsville, Virginia, at: 10:00 a.m., October 1, 2020 (the "Sale Date") the following described property with improvements thereon (the "Property"), situate, lying and being in Henry County, Virginia, and being described as follows: All those four (4) certain lots or parcels of real estate, together with the improvements thereon and appurtenances thereunto belonging, situated on the south side of Hill-N-Dale Drive in the Martinsville District of Henry County, Virginia, which lots are known and designated as Lots 5, 6, 7 and 8, Section "E" of the Gaynor Heights Subdivision, as shown on a record plat of Gaynor Heights Subdivision, prepared by W. C. Brown, C.L.S., dated June 24, 1960, and recorded in the Henry County Circuit Court Clerk's Office in Map Book 16, page 5, and also shown on survey for Dallas James Frazier and Linda Critz Frazier as prepared by J. A. Gustin, C.L.S., on October 16, 1979. BEING the real property acquired by Dallas J. Frazier and Linda C. Frazier, husband and wife, from James Darby Cox and Marlyn Burton Cox, husband and wife, by Deed dated October 31, 1979, of record in the Henry County Circuit Court Clerk's Office in Deed Book 313, Page 393. Linda Critz Frazier having acquired said real property by right of survivorship when Dallas J. Frazier died intestate on April 22, 1983. This sale is subject to all conditions, restrictions, reservations, declarations, easements, leases and rights-of-way of record or contained in the deeds forming the chain of title to the Property, and subject to any and all prior liens, including, but not limited to recorded and unrecorded mechanics' and materialmens' liens, if any. WARRANTIES: THE PROPERTY AND ALL THE IMPROVEMENTS LOCATED THEREON WILL BE SOLD IN THEIR "AS IS" CONDITION WITHOUT WARRANTY OF ANY KIND. TERMS OF SALE: ALL CASH. Purchaser shall pay for all recording charges (EXCLUDING Grantor's Tax), examination of title, settlement fees and all costs of conveyancing. Transfer of title of the Property to the purchaser shall be by special warranty deed of bargain and sale. To bid on the Property, each bidder, other than the noteholder, shall qualify as a bidder by demonstrating to Substitute Trustee prior to bidding the ability of such bidder to satisfy deposit requirements immediately upon acceptance of a bid by delivery to Substitute Trustee of deposit IN CASH or by CERTIFIED or CASHIER'S CHECK of $3,500.00, or 10% of the sale price, whichever is lower. Unless otherwise agreed to in writing, settlement in full shall be made within 30 days from the date of the sale. Taxes will be pro-rated to the date of the sale. If the Substitute Trustee fails to convey title to the Property to the Purchaser, the Purchaser's sole remedy is return of the deposit. Delivery of possession of the Property will be the responsibility of the purchaser. The Purchaser may be required to execute a Memorandum of Sale containing terms and conditions relating to sale and the purchase of the Property, a copy of which will be available immediately before the sale. The Substitute Trustee reserves the right to amend terms of the sale by announcement prior to sale.
